Tv\u00e5 omr\u00e5den som \u00e4r s\u00e4rskilt viktiga att ha koll p\u00e5 n\u00e4r man rekryterar \u00e4r <strong>GDPR<\/strong> och <strong>Diskrimineringslagen<\/strong>. N\u00e4r det handlar om dessa tv\u00e5 delar har vi m\u00e4rkt att m\u00e5nga f\u00f6retag brister i sin kunskap, n\u00e5got som kan bli b\u00e5de bli dyrt och tidskr\u00e4vande.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading h4\"><strong>Diskrimineringslagen \u2013 Vad s\u00e4ger lagen?<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/www.riksdagen.se\/sv\/dokument-lagar\/dokument\/svensk-forfattningssamling\/diskrimineringslag-2008567_sfs-2008-567\">Diskrimineringslagen (2008:567)<\/a> f\u00f6rbjuder direkt och indirekt diskriminering baserat p\u00e5; <em>k\u00f6n, k\u00f6nsidentitet, etnisk tillh\u00f6righet, religion, funktionsneds\u00e4ttning, sexuell l\u00e4ggning <\/em>och <em>\u00e5lder.<\/em><\/p>\n\n\n\n<p><strong>Att t\u00e4nka p\u00e5 i en rekrytering<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Krav i platsannonser ska vara sakliga och relevanta.<\/li>\n\n\n\n<li>Undvik intervjufr\u00e5gor som kan kopplas till diskrimineringsgrunder.<\/li>\n\n\n\n<li>Kandidaterna kan \u00f6verklaga ett avslag i upp till tv\u00e5 \u00e5r, vilket inneb\u00e4r att du beh\u00f6ver dokumentera rekryteringen och spara ans\u00f6kningarna minst tv\u00e5 \u00e5r.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading h4\"><strong>GDPR \u2013 Dataskydd i rekryteringsprocesse<\/strong>rna<\/h2>\n\n\n\n<p>GDPR st\u00e4ller krav p\u00e5 hur personuppgifter hanteras under en rekrytering. Det handlar om transparens, s\u00e4kerhet och ansvar.<\/p>\n\n\n\n<p><strong><strong>Att t\u00e4nka p\u00e5 i en rekrytering<\/strong><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Uppr\u00e4tta en integritetspolicy &#8211; Kandidaten ska f\u00e5 information, i samband med ans\u00f6kan, om hur l\u00e4nge ni sparar uppgifter och vilka r\u00e4ttigheter de har.<\/li>\n\n\n\n<li>Kontroll p\u00e5 beh\u00f6righeter &#8211; Ha koll p\u00e5 vem som har tillg\u00e5ng till ans\u00f6kningarna och om de har en anledning till att ta del av dem.<\/li>\n\n\n\n<li>Inkommande ans\u00f6kningar i mailkorgen &#8211; Ha koll p\u00e5 vem som har tillg\u00e5ng till inkorgen, vem som tar hand om den om n\u00e5gon slutar samt s\u00e4kerst\u00e4ll att personuppgifter och annan k\u00e4nslig data raderas efter r\u00e4tt tid.<\/li>\n\n\n\n<li>Ans\u00f6kningar p\u00e5 dator eller molntj\u00e4nst &#8211; Ha koll p\u00e5 vem som kommer \u00e5t dem, vem som ansvarar f\u00f6r radering av data efter tv\u00e5 \u00e5r och vem som tar \u00f6ver om n\u00e5gon slutar.<\/li>\n\n\n\n<li>Ans\u00f6kningar som skrivs ut &#8211; Ha koll p\u00e5 vem som kan se dokumenten och vem som ansvarar f\u00f6r att de kasseras efter r\u00e4tt tid.<\/li>\n\n\n\n<li>Kontinuerlig gallring &#8211; Radera personuppgifter n\u00e4r rekryteringen \u00e4r avslutad, om inte annat \u00e4ndam\u00e5l tydligt framg\u00e5r. Dock m\u00e5ste du spara ans\u00f6kningar i minst tv\u00e5 \u00e5r f\u00f6r att f\u00f6lja diskrimineringslagstiftningen. Du f\u00e5r spara vissa ans\u00f6kningar l\u00e4ngre om det finns dokumenterat och ber\u00e4ttigat intresse fr\u00e5n b\u00e5da parter.<\/li>\n<\/ul>\n\n\n\n<p>Vid \u00f6vertr\u00e4delser kan sanktionsavgifter uppg\u00e5 till <strong>20 miljoner euro eller 4 % av koncernens globala \u00e5rsoms\u00e4ttning<\/strong>, det h\u00f6gsta beloppet g\u00e4ller.
